By accessing or using any software, products, or services provided by Forgeborn ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our products or services.

We may update these terms from time to time. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.

You may use Forgeborn products and services only in compliance with these terms and all applicable laws and regulations. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to our systems, infrastructure, or other users' accounts
• Interfere with or disrupt the integrity or performance of our services
• Reverse engineer, decompile, or disassemble any Forgeborn software unless expressly permitted by applicable law
• Resell, sublicense, or redistribute our products without prior written consent
• Use automated tools to scrape, crawl, or otherwise extract data from our services beyond normal use

All Forgeborn software, content, trademarks, logos, and documentation are the exclusive property of Forgeborn and are protected by applicable intellectual property laws. These terms do not grant you any ownership rights in our products or services.

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use our products and services for their intended purpose.

Any data or content you provide to our services remains yours. You grant us only the rights necessary to operate and provide the services to you.

You retain ownership of all data and content you submit to our services. We do not sell, share, or use your data for purposes other than providing and improving our services.

For self-hosted products, your data remains on your infrastructure under your control. We do not have access to your data unless you explicitly grant it for support purposes.

We strive to keep our services available and reliable, but we do not guarantee uninterrupted or error-free operation. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice where practicable.

To the maximum extent permitted by law, Forgeborn and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of our products or services.

Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you paid to Forgeborn in the twelve (12) months preceding the claim.

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify and hold harmless Forgeborn from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, your violation of these terms, or your violation of any rights of a third party.

We may suspend or terminate your access to our services at any time if you violate these terms or if we reasonably believe such action is necessary to protect the security or integrity of our services.

Upon termination, your right to use our services ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.
